Microdermabrasion injury, should I settle?


I was actually injured while getting a microdermabrasion facial. I have been to the doctor and the owner of the spa did reimburse me the facial cost + medical expenses. This has been very emotionally traumatic (my face is covered in abrasions). I told the spa owners that I wanted compensation. They are contacting their insurance company on Monday. Does anyone know about the personal injury laws in Ohio? Should I take what the insurance company offers? What am I entitled to? I really don't like the idea of getting a laywer...they will go after so much money because they will get a percentage. So does anyone have an opinion? My face has a severe abrasion/scrape on my right cheek bone a couple of large ones on both sides of my jaws and then mild abrasions here and there. The day of the facial I was burnt red w/swelling and bleeding (Thurs). The doctor doesn't think there will be scarring but this has been so emotional for me and I can't leave the house, have had to cancel a lot of plans.

    Why dont’ you want to have lawyer to represent your case? Of course, they will go after money coz they get percentage. But the percentage that you will get would be more than the lawyer will get. After all, it’s all for you. If you keep quiet, the salon will be very happy. Because of their technique or unskill facial therapy, your face get hurt. I mean "YOUR FACE"! Did they warn you if something like that could happen after your facial section? If they didn’t, don’t stay quiet. What does their insurance company offer you? You are hurt both physically and emotionally. Is thier offer going to cover what have been going through right now? I guess not. Usually, they dont’ offer you for what you deserve. They just want to shut you up. I’m sorry that happened to your face. I can understand your feeling. I think you should at least discuss with someone who knows the legal terms. Do not decide on your own. Talk to your family or really good friends of yours. Having a lawyer represented you is not only about money but also about giving a punishment to that stupid salon. If they are not skillful in that facial treatment, they shouldn’t have offered it in the first place. Because of their dishonesty, you became a victim. Dont’ let them fool you with small amount of money. Fight for it. Good luck!

    You MUST get yourself an attorney. DO NOT speak to, or make any settlements with ANY insurance company. Trust me. my husband and I have been through this, actually Monday Feb.19th we will be finalizing the paper work for a settlement. You can negotiate with an attorney for their percentage. An insurance company will offer you pennies on the dollar. When our situation first happened, the insurance co. wanted to give us very little$$$$ Now we are receiving 7 times the amount and several other benefits. If you do not feel comfortable, take someone that you know with some experience, so they can help you decide, if,and what, the attorney says is reasonable to you. Even though the Dr. feels there will be no scarring, it takes time for that to be determined. If the owner of the spa was so quick to reimburse you, and now is contacting their insurance company, it is to make sure that they are "protecting themselves" in regards to their legal responsibility. If you accept ANY money from the insurance company,you will NEVER be able, legally,to go after the spa for ANY damages, that might result from your injury in the future. Once you take money from the INSURANCE company, you will have to sign a document, that states you accept the money, and, that by doing so, there is no admission of guilt on the part of the spa.Take a little time to find out what your LEGAL options are!
