I allowed a family of 4 to stay in my home temporarily until their home closed escrow. No rent, no lease ?


This family was to maintain the landscape, pool-spa, pay utilities, show home to prospective buyers, keep home in showing condition. Pool is green, I've been served w/code violation on pool condition. They dismissed my pool service, grass is dying, 4 sale sign is removed. Locks are changed, I cannot enter, my personal belongings and furniture are in the home.
Home is located in California. Locks are changed I'm locked out of the home and cannot access my personal items nor furniture, I received a code violation for the green pool. How do I get pocession of my home.

    The sheriff and a locksmith will get you inside.

    You need to evict them to get them out though. Nothing personal, but this was not a very smart thing to do. I think you should hire an eviction service to evict them, it will cost 600. If you made this big of a mistake you will make a mistake with the eviction and they will be there longer.

    Do you have this agreement in writing? You can get the police, show them proof you own the home and they can get you back inside, but if you don’t have proof to them agreeing to maintain everything you’re out of luck.

    First of all, see a lawyer immediately. The lawyer will advise you if you have to go through eviction proceedings, or if you can call a locksmith and have the locks replaced, and lock them out. It depends on your local and state laws as to how to proceed. I would also call the police and tell them that you have squatters that locked you out, and see what they advise. Good luck to you.

    Call a locksmith so you can gain access to the property. When you come into contact with the family tell them the gig is up and to move out immediately. If they refuse, simply call the police and have them arrested. If there is no lease, and you asked them to leave, its trespassing, case closed. Its really that simple.

    This is why you should get everything in writing. Regardless, it’s your home. Call the Sheriff to break the locks and get them out.
